Terms & Conditions

1. The Contract
This booking form, signed/accepted by the Customer for booking the required services (“Booking Form”), together with these Conditions and any acceptance of a booking by The Peak Vibes Tours and Travels Company (hereafter referred to as “the Company,” registered at Shop no-30,bharvi tower,ahmedabad-gujarat, forms the sole basis of the contract (“Contract”) between the Company and the Customer signing the Booking Form/accepting it with an advance payment upon receiving the itinerary via any electronic medium. Hereafter, the term “Customer” refers to all members benefiting from the travel services mentioned in the Booking Form.
By making a booking, the Customer guarantees they have the authority to accept these Booking Terms and Conditions on behalf of all named individuals. For corporate Customers, the authorized representative must ensure compliance. No employee or agent of the Company is authorized to vary these Terms and Conditions.

2. Brochures Validity
The Company takes reasonable care in preparing brochures, price grids, web pages, and other documents. However, typographical or printing errors may occur, and the Company is not liable for them. Brochures are printed in advance and may not reflect updated details. Customers should verify the validity of brochures with the Company. Photos of meals, sights, and properties are for reference only and may differ from actual experiences. Distances, temperatures, and hotel locations are approximate and subject to change based on road conditions, travel schedules, and climate.

3. Itinerary Changes
The Company reserves the right to modify, amend, or alter itineraries before or during the tour due to unforeseen circumstances, including but not limited to Force Majeure events, strikes, weather changes, or overbooking. Customers will be notified promptly of such changes by our representatives or tour managers. No grievances regarding these adjustments will be entertained after the tour.

4. Booking
Bookings can be made through the Company’s offices or authorized representatives. Customers aged 18 or above must submit a signed Booking Form with the required deposit or full payment. Bookings for minors must be made by their legal guardians, who must accompany them during travel. Confirmation is subject to availability and payment completion. Group changes are not permitted within 90 working days of the travel date.

5. Prices and Payment
Prices are subject to availability and may vary during peak periods. Final prices are guaranteed only upon full payment. Price changes may occur due to currency fluctuations, airfare increases, or new government regulations. Customers must pay any additional costs resulting from such changes.
Payment Methods: Payments can be made via cash, credit/debit cards, cheques, NEFT, or bank transfers. Taxes, TCS (Tax Collected at Source), and additional service charges, if applicable, will be borne by the Customer.

6. Booking Change or Cancellation Policy
By the Company: If the Company alters or cancels a booking, it will offer alternative arrangements or refunds after deducting non-refundable charges. However, the Company is not liable for consequential losses or additional expenses.
By the Customer: Cancellation requests by Customers will incur charges as per the Company’s Cancellation Policy. No refunds are permitted after VISA approval.
By Suppliers: If services are canceled by airlines, hotels, or suppliers due to regulatory changes, the Customer must bear additional expenses beyond the package cost.

7. Travel Documents
It is the Customer’s responsibility to ensure valid passports, visas, and other required travel documents. The Company assists with documentation for an additional fee but is not liable for document-related inconveniences or expenses.

8. Meals
Meals will be provided as per the itinerary. Special dietary requirements cannot be guaranteed. Customers requiring specific arrangements due to medical or personal needs are advised to opt for customized tours.

9. Hotels
Hotel accommodations will be arranged based on comfort and value. Room types, check-in/out times, and additional services are subject to hotel policies and availability.
Single Rooms: Subject to a single supplement fee.
Double Rooms: Offered based on availability of queen-size or twin beds.
Triple Rooms: May include rollaway beds and are recommended for a maximum of three persons.
Child Accommodation: Separate beds for children are available based on prior booking and charges.

10. Force Majeure
The Company is not responsible for events beyond its control, such as natural disasters, political unrest, or delays caused by third parties. Customers must bear additional costs incurred due to such circumstances.

11. VISA
Applicants must personally visit the VFS Facility Center for document submission, as biometric data collection is mandatory for the U.K. and Europe, or as required by the destination country. The Peak Vibes will provide necessary land documents, including hotel and airline confirmations, bus seat confirmation, land confirmation letter, online appointment, and insurance copy for visa processing. If online appointments are unavailable, applicants may need to proceed with VAYD services at their own cost.
The Peak Vibes is not responsible for any additional fees beyond the standard visa fee, including charges for premium services at VFS. Applicants must arrive at the VFS Centre on or before their appointment time, as late arrivals may be denied entry. Visa processing and approval are at the sole discretion of the consulate, and The Peak Vibes is not liable for any rejections. All payments to VFS or the consulate are non-refundable.
The nonrefundable service charge and advance payment of ₹20,000 for package and seat blocking paid to The Peak Vibes are nonrefundable under any circumstances. If a personal interview at the consulate is required, applicants must attend at their own expense.

12. The Company’s Responsibilities and Liabilities
The Company acts solely as an intermediary for travel-related products provided by various suppliers such as airlines, coach operators, hotels, and local transport services. While care is taken to select reputable service providers, the Company holds no liability for the acts or omissions of third parties.
All bookings are made subject to the terms and conditions of the respective service providers. Copies of these terms can be provided upon request. The Company is not liable for any injury, damage, loss, delay, or inconvenience caused by third parties, force majeure, or events beyond its control.
Travel services are also subject to international conventions like the Warsaw Convention (air travel), Athens Convention (sea travel), and others. The Company is not responsible for changes in rules by airlines, hotels, or any service providers.
Customers are responsible for their own behavior during tours. If disruptive behavior occurs, the Company reserves the right to terminate travel arrangements without refund.
Additional costs arising from delays, changes in schedules, or cancellations by service providers must be borne by the Customer. It is strongly recommended to purchase travel insurance.

13. Customer Responsibilities
Complimentary breakfasts are typically continental and fixed by the hotel. They cannot be altered.
Indian lunches/dinners provided are vegetarian/non-vegetarian, as per the itinerary.
Any damages caused to property during the tour must be borne by the Customer.
Customers must follow the tour manager’s instructions for smooth operations.
Visa fees and flight tickets are non-refundable under any circumstances.
Local lunch options may include burgers, pizzas, fish and chips, kebabs, KFC, McDonald’s, or Indian meals.

14. Complaints/Refunds
Complaints must be reported immediately to the local representative. If unresolved, they must be submitted in writing to the Company within 30 days after the tour. No refunds are available for unutilized services.

15. Governing Law
Any disputes will be governed by Indian laws, with exclusive jurisdiction conferred upon courts in Thrissur district.

16. Force Majeure
The Company is not liable for events beyond its control, such as natural disasters, strikes, or government actions.

17. Limitation of Liabilities
The Company’s liability will not exceed the fees charged.

18. Severability
If any term is deemed unenforceable, the remaining terms will still apply.

19. Vaccination
Travelers must have completed their last dose of vaccination at least 14 days, and no more than 270 days, before their trip.

Important Notes:
Extra costs due to flight schedule changes or unforeseen circumstances must be borne by the Customer.
Customers are responsible for timely attendance at the coach, flight, or tour activities.
Unutilized services are non-refundable.
Customers must adhere to hotel rules, including non-smoking policies and avoidance of food stains or water spillage. Penalties may apply.
